Software Use Agreement
1. Adoption and Scope
The use of the software by the User for the software provided by the Service Provider automatically implies acceptance of the terms and conditions of the Agreement. The User shall comply with and follow these terms and conditions when using the Software.
The Agreement shall enter into force upon signature by both parties.
The validity of this Agreement shall continue until the expiry of the existing contract between the Service Provider and the User for live storage. After the termination of the valid contract, the User shall have access to the data generated during the use of the Software for a period of 180 days, with viewing/downloading rights only.
2. Description of the Service
Software description: an entitlement-based, modularly structured site management software, designed to digitise all activities that can be linked to the access points of sites at any level. The main modules of the software are: digital service handover, patrol control, key management, electronic logging, passenger, vehicle check-out, guest, service, goods delivery and time reservation, logistics management and the additional modules.
Infrastructure: the Service Provider provides and makes available the Software to the User through a cloud-based platform. This model allows the User to use and access the Software through a Chromium-based browser without having to install or host the Software on its own servers. It is the User's responsibility to provide internet access (in the absence of which: mobile internet provided by the Service Provider)
Hosting providers:
- Rackforest Zrt., ISO/IEC 27001 and ISO 9001 certified server rooms
- DigitalOcean Holdings' server rooms in the EU
3. Service availability, accessibility and product support
The Software is available at https://gate.patentapp.eu.
The availability of the Software is guaranteed 99.9%. This does not include scheduled maintenance performed at a time agreed in advance with the User.

Service Provider provides product support for the Software. The Service Provider shall provide support for the Software by making the Software available within 2 hours during working hours (8.00 a.m. to 4.00 p.m.) and within 8 hours outside working hours, in case of troubleshooting of any errors that prevent work.
Support for the Software includes:
- 1. Perform user registrations and site-specific settings.
- 2. Troubleshooting.
- 3. Assistance in using the Patent Gate portal programme, "Helpdesk" tasks.
- 4. Recommend and present existing and new developments and solutions for site optimisation.
- 5. Openness to specific development needs for the Patent Gate portal programme.
After the termination of the contract (during the 180-day viewing period), product support is limited to being available from 8.00 a.m. to 4.00 p.m. on weekdays and to handling bug fixes.
4. Terms of Use
The User must provide the necessary conditions (computing device, internet, Google Chromium browser) to use the Software.
The Service Provider shall provide access to the Software via the Internet.
The User may use the Software for the performance of its own tasks within its own organisational framework, may not transfer its use to third parties and shall not make it available to third parties in any way. For the purposes of its use of the Software, a person who is in an employment relationship or other legal relationship for the purpose of employment with the User shall not be considered a third party.
5. Liability and Indemnity
The Parties shall immediately notify each other of any circumstances that jeopardise, hinder or prevent the provision of the service to an adequate standard.
The User undertakes to inform all persons who may use the Software during the term of the valid contract of the provisions of this Agreement.
It is the responsibility of the User to inform the Service Provider of any circumstances in his/her interest that affect the provision of the Service prior to entering into the Agreement. The Service Provider shall not be liable for any disruption or failure to provide the Service resulting from the User's failure to inform the Service Provider prior to entering into the Agreement.
The Service Provider shall not be liable for any interruption or failure of the Service due to a cause attributable to the User.
6. Disputes and Termination
The Parties agree to submit to the exclusive jurisdiction of the Győr-based court, depending on its jurisdiction, in case of disputes arising from this Agreement, if they cannot be settled amicably between the Parties.
The parties may terminate the contract at any time by mutual agreement, otherwise the rules on the termination, cancellation or amendment of the contract in Act V of 2013 on the Civil Code shall apply.
